Terms and Conditions

These are general terms + conditions that you agree to when retaining or using Oriana Photography’s services or products.  

 

Retainer & Payments:

With your retainer payment, your wedding, portrait, event, or conference photography session date, time, and location is added to the Oriana Photography calendar and we begin preparations and planning around your date, such as turning down other inquiries and booking or not booking travel.

In the event of Client Cancellation or change of date, time or location, the retainer payment is non-refundable and non-transferable.

Usage and Permissions

Copyright Info:

Photographer retains copyright to all images produced and grants Client license to use images for personal use.

Limited Commercial Use:

Images may not be given by Client to other businesses.

Commercial use requires written permission from Photographer, and may require an additional license.

Limited Model Release:

Client grants to Photographer permission to publish photographs of Client for marketing

and promotion of Oriana Photography, including in editorial, blogs, and advertising.

Deliverables, Expectations & Other Circumstances

Deliverables:

Photographer will make available a curated selection of gently edited high-resolution jpg images for download by client as the final deliverables. Your invoice or contract may stipulate a specific number of maximum included images. 

Permission to Print:

Photographer grants to Client permission to print the final delivered images, as many copies as they would like for personal use.

Artistic License:

Photographer uses their artistic discretion to determine the final images for delivery and gently editing in Photographer’s style. 

“RAW” files are not available.

Additional more extreme edits (such as, for example, body modifications, changing the appearance of clothing, etc) are not included.

Downloading:

Final images will be delivered online via a client gallery where client can access final images for viewing and downloading.

Image Storage:

Most clients download their photos right away when they are delivered.  For convenience, Photographer will store images online free of charge for six months from delivery date for all projects. If your invoice or contract provides for a longer storage period, the period of time as named in the invoice or contract will be honored.

Photographer is not responsible for storing images indefinitely.  Photographer may charge a fee to restore images to the server, if they are available, but is under no obligation nor responsibility to do so after six months from original delivery date.

Rain Policy – Non Wedding Photography: 

If significant rain is forecasted on the day of your reserved portrait photography session, Photographer will communicate with you via text or phone on that day regarding weather and the best outcome for your photos.

For clarity’s sake, only Photographer can determine a rain cancellation, and here is the process: 1) Will communicate with you on the day of if rain is in the forecast and then 2) will confirm in writing via email. In the event of a rain cancellation or change as confirmed by Photographer in writing, Client has the option to instead choose another time for the session – or – if no back up time is available or desired, the retainer will be refunded.  This is the only circumstance where the retainer will be returned.

(Rain policy does not apply to Weddings, Elopements, or Vow Renewals, which are reserved rain or shine per wedding contract).

Late Payment or Failure to Pay: It’s important for balance to be paid in full by the date due for a seamless experience.  Photographer does not deliver images before balance is paid in full, and late payments may significantly lengthen delivery times.  If remaining balance due is not paid in full by seven days past due, Photographer will consider the project abandoned by Client and Photographer will have no further responsibility.

Limitation of Liability:

Photographer’s entire liability for any claim, loss, damage, or injury arising under or relating to this agreement or use of services is limited to the fees paid directly to the Photographer for the specific service.

In no event shall Photographer be liable for special, incidental, consequential, or punitive damages, even if client informs Photographer of circumstances that would give rise to such damages.

Agreement: By directly or indirectly retaining or using Oriana Photography products or services in person, via email, or on this website you agree with the terms + conditions.
